- These terms are a binding and enforceable contract between you(the user) and us (Handmade Soko and all affiliated partners). You will be bound by these terms whenever you use any of our services. Should you not agree to these terms, please do not use any of our services.
- These terms and our privacy policy will be changed by us from time to time without any prior notice to you.
- All our services will be provided to you ‘as is’, ‘as available’ and at our discretion. Handmade soko reserves the right of admission and may terminate the access to your profile or account without notice to you if you breach these terms or your activity violates our genuine interest.
- Handmade soko has no control over and does not give any guarantee regarding quality, availability, safety, legality or warranty for any goods or services listed on our site or the authenticity of any information provided on our site by users.
- You are responsible for ensuring that you check and verify the quality of goods and services listed. You are also encouraged not to pay for any goods until you are fully satisfied with the credentials of the sellers and quality of goods.
- You are solely responsible for your safety when you agree to meet any other users in order to complete a transaction. You are responsible for observing safety guidelines such us meeting in a public place and during the day among other safety measures. Handmade Soko is not responsible or liable for any such transactions among individual or organization users.
- You can create only one account(profile) on our service and may do so as an individual or as an organization. We will request you for information during account opening and may also request you for additional information to verify your identity and to comply with regulations, and fulfil our obligations and discharge our services. You are required to provide this information within the timelines that are stipulated by any applicable law or by these terms.
- By using our services, you agree to be solely responsible for privacy and confidentiality of access to your profile and for any activity and transactions that are carried out using your access/profile. You also agree that you are above 18 years. If you not of legal age, you confirm that you will be supervised by a parent or guardian while using our services and that your parent or guardian has read and accepted the terms of this agreement.
- You agree that you are responsible for notifying us as soon as you notice any unauthorized use of your profile/account. We will not be liable for any loss of damage resulting from any such unauthorized access or by your failure to comply to these terms.
- Handmade soko is an online listing service which includes publishing listings by users, allowing users and online visitors to view published listings and also a facilitator of communication between users and visitors using the information that they provide in their listings. We do not sell, market or own any products or services that are listed on our website. Handmade Soko does not act on behalf of any users or organizations and is not a party to any transactions between users.
- Handmade Soko may delete/disable any listings or posts with or without notice to users following a request by regulatory or authority body, a violation claim from a copyright or patent or legal owner, breach of these terms, the law and any applicable standards or rights and genuine interests of other users or other reasonable requests from individuals or organizations. Handmade Soko is not required to provide substantiation for such deletion.
- Handmade Soko may make changes or carry out various activities on any of their services and content with or without notice to you. You agree that these changes may result in your inability to access the service or content for a short period of time or permanently. Handmade Soko is not liable for any results of such changes without limitation including deletion of or inability to make the service available to you or provide access to any content permanently.
- Handmade Soko is not liable for any content provided by users on the service and cannot guarantee the accuracy, usability, safety, or legality. Users will be solely responsible for their content and any other content that they interact with while using our services.
- Handmade Soko has no control over the content and interaction between users and is not responsible for the moderation of any user content and is therefore not be obligated to be involved in any disputes between users or be liable for any loss or damage resulting in interactions between users. Users agree that are solely responsible for such interactions and content.
- Handmade Soko will have links to third party sites and services. Handmade Soko will have no control over third party services and will not guarantee their accuracy or usability. Users will be solely responsible for the verification and investigation of any third party services before using them.
- By using our services, you have agreed to be bound by these terms and thereby indemnify and release Handmade soko, its owners, employees, officers, partners, affiliated parties and successors from any liability, damages, rights, claims, demands, actions, losses, injury or death that occurs as a result of interacting with our services or service users in any way directly or indirectly.
- Users are required to provide proof of ownership and rights to products and services that they have listed upon request by Handmade Soko. Users must provide all relevant information regarding any listings that thy post on our services including the related terms and conditions. User listings and terms related to their listing must not in any way violate our(Handmade Soko) terms and conditions. Users are responsible for the details they provide on listings such as price and specific conditions of goods and services listed. Users must provide specifications for any changes of these details and will bear responsibility for any perceptions or assumptions made as a result of the listing details or any changes made.
- Users will be bound by the terms and conditions of any third party services that they use such as YouTube, Pinterest, or any other external services used when using our services.
- Fees to our listing services are generally waived but may contain other payable service e.g limited number of listings in certain categories and locations. All fees for our services and for using selected payment methods will be disclosed on the service and may be changed from time to time with or without notice to you. Unless stated otherwise in the service invoice/agreement, fees are non-refundable. Get more information from our billing policy.
- Users agree that by using our service, they are above 18years, and have the legal capacity to use our services in the manner that they use them, and that they will provide true accurate information and will not provide any information that is false or that results in misleading of other users and stakeholders. You agree that you will be responsible for changing your account detail and informing Handmade Soko in the event of unauthorized access to your account.
- You agree that you will use the services in good faith and in strict observance of the terms and any applicable laws, regulations, standards and rules. You agree that you will not use the service for any illegal, harmful or unauthorized purposes or infringe on the rights of other users in any way and will not list any forbidden/prohibited items under our terms or applicable laws.
- You agree that you will not include content in your listings that contains or promotes the use of any personal information of minors, false/misleading statements, overtly sexual material, illegal and reckless use of weapons and dangerous items, prohibited items, hateful language, negative ethnicity, harassment, discrimination, racism, violence, immorality and unlawful actions including any and every action prohibited by applicable laws.
- You agree that your listing will not contain direct or indirect link to websites or services that are in competition with our services and must contain an actual product or service that is being sold or offered. You must not use any software or material that has the capacity to interfere with this service and must not share or distribute any unsolicited material, chain mail or illegal marketing models using any of our services
- You must have legal ownership of any items that you offer or sell on our service and are legally required to have authorization, permits and licenses that are required by applicable law.
- You must not copy, download, process or use any information about other users on our service without their consent. Information provided by users will only be used in relation to their listing and users who use this information without consent are liable and will be in violation of our terms. - Handmade Soko and all its affiliates are not liable for your use or inability to use our services, loss or damage to any of your devices or any financial or material loss or any loss of data or information in any form or way be it direct or indirect or accidental or perceived. You are solely responsible for any eventuality while using our services and Handmade Soko is wholly and fully indemnified.
- Handmade Soko does not assume ownership of any data and information that you provide on our services. Handmade Soko may however retain, copy, process, distribute, make public, analyze, store, use for marketing, make modifications, and other purposes within its genuine interests.
- Any content on the platform that is not provided by the user like texts, software, graphics, and trademarks, logo and identities and marks belong to Handmade Soko and must not be used without prior consent.
- In accordance with the law, individuals or organizations may request Handmade Soko to consider deletion of any materials that violates their property rights. These requests must have a legal basis and must be in good faith. These requests can be sent to websupport@handmadesoko.co.ke and must be clear and contain all the relevant information required to warrant consideration. Handmade Soko will not be liable if such requests cannot be actioned due to lack of detailed information or omissions by the requestor or because of circumstances that are beyond reasonable control.
- These terms are governed by the laws of Kenya and any disputes will be settled in accordance with the applicable arbitration rules in English or Swahili.
- Our rights in these terms may be transferred by us to any person with or without any notice to you. We reserve the right to use our rights in these term in any way even if we do not take action in respect to any breach of these terms. Handmade Soko will not be liable to any failure to comply to these terms if it is not within reasonable control.
